Terms and Conditions

(hereinafter referred to as "Seller")

§ 1 Scope of Application

(1) These Terms and Conditions (hereinafter "T&C") apply to all contracts concluded between the Seller and the customer (hereinafter "Buyer") through the Seller's online shop.

(2) The version of the T&C valid at the time of the conclusion of the contract shall apply.

(3) Deviating terms and conditions of the Buyer are not recognized unless the Seller expressly agrees to their validity in writing.

(4) The business relationship between the Seller and the Buyer is subject to the laws of the Republic of Cyprus, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence is not withdrawn (principle of favorability pursuant to Art. 6(2) Rome I Regulation).

§ 3 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order (invitatio ad offerendum).

(2) By clicking the "Place Order" button (or similar designation), the Buyer submits a binding purchase offer. The Buyer is bound by this offer for a period of five (5) business days.

(3) The Seller confirms receipt of the order immediately by an automated email (order confirmation). This order confirmation does not constitute acceptance of the offer but merely informs the Buyer that their order has been received by the Seller.

(4) The purchase contract is concluded only when the Seller accepts the Buyer's offer by a separate order confirmation email or by executing the delivery.

(5) If the Seller allows advance payment, e.g., payment by bank transfer in advance, the contract is concluded upon provision of bank details and payment request.

§ 4 Right of Withdrawal

(1) Consumers are entitled to a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

(2) The detailed cancellation policy and the model withdrawal form can be found in our separate Cancellation Policy.

§ 5 Prices and Shipping Costs

(1) All prices stated in the online shop are final prices including the statutory value-added tax.

(2) In addition to the stated prices, the Seller charges shipping costs for delivery. The shipping costs are clearly communicated to the Buyer on a separate information page and during the ordering process.

(3) The current shipping costs are:

  • EU-wide shipping: €12.90 flat rate
  • Switzerland: €12.90 flat rate (plus any customs duties and import taxes, which are to be borne by the Buyer)
  • Free shipping for orders over €150.00

(4) For deliveries to Switzerland, additional customs duties, taxes, and fees may apply, which are to be borne by the Buyer.

(5) For consumers: Erroneously stated prices may be corrected provided the Seller informs the Buyer before the conclusion of the contract. An already concluded contract remains unaffected.

§ 6 Payment Terms

(1) The Buyer may make payment by credit card (via Shopify Payments), PayPal, or other payment methods offered during the ordering process.

(2) Payment of the purchase price is due immediately upon conclusion of the contract. The charge is made at the time of order.

(3) The invoice is sent to the Buyer by email upon shipment of the goods.

(4) If payment of the purchase price by advance bank transfer is agreed, payment is due immediately after conclusion of the contract.

(5) If the Buyer defaults on payment, the Seller is entitled to charge default interest at a rate of 5 percentage points above the base rate. For entrepreneurs, the interest rate for default interest is 9 percentage points above the base rate. The Seller reserves the right to prove and claim higher default damages.

§ 7 Delivery Terms

(1) Delivery is made to the delivery address specified by the Buyer.

(2) The Seller delivers to all EU member states as well as Switzerland. Delivery to the United Kingdom is currently not possible.

(3) The estimated delivery time is 3–5 business days after receipt of payment. Deviating delivery times are indicated on the respective product page.

(4) Shipping is carried out by the following carriers: UPS, DPD, DHL Express. The choice of carrier is at the Seller's discretion.

(5) If the Buyer makes re-delivery necessary by providing an incorrect address or by not collecting from the parcel service, the Buyer shall bear the costs of re-delivery.

(6) In the event that the Seller cannot deliver the ordered product because they are not supplied by their own suppliers through no fault of their own, the Seller is entitled to withdraw from the contract. In this case, the Seller will inform the Buyer immediately and, if applicable, propose the delivery of a comparable product. If a comparable product is not available or the Buyer does not wish delivery of a comparable product, the Seller will immediately refund any consideration already rendered by the Buyer.

(7) For deliveries to Switzerland, packages are sent as DDP (Delivered Duty Unpaid). The Buyer is responsible for paying all applicable import duties, customs duties, and taxes.

§ 8 Retention of Title

(1) Until full payment of the purchase price, the delivered goods remain the property of the Seller.

(2) The Buyer is obligated to treat the goods with care for the duration of the retention of title. In particular, they are obligated to adequately insure them at their own expense against theft, fire, and water damage at replacement value, insofar as such insurance is customary in the industry.

§ 9 Warranty and Guarantee

(1) The statutory warranty rights apply.

(2) For consumers, the warranty period is two (2) years from delivery of the goods in accordance with the EU Sale of Goods Directive (2019/771).

(3) For entrepreneurs, the warranty period is one (1) year from delivery of the goods.

(4) The Buyer's warranty rights presuppose that the Buyer has duly fulfilled their statutory obligations to inspect and give notice of defects (§§ 377, 381 HGB) (applies only to merchants).

(5) Any guarantees granted by the manufacturer remain unaffected. Such guarantees, if available, are indicated separately on the product page or in the product documentation.

§ 10 Liability

(1) The Seller is liable without limitation for intent and gross negligence.

(2) In case of slight negligence, the Seller is only liable for breach of essential contractual obligations (cardinal obligations). Liability is limited to the typical, foreseeable damage.

(3) The above limitations of liability do not apply to injury to life, body, or health, nor to liability under the Product Liability Act.

(4) For consumers, the statutory liability provisions apply.

§ 11 Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy, which forms part of these T&C.

§ 12 Dispute Resolution

(1) The European Commission provides a platform for out-of-court online dispute resolution (ODR platform), which is available at https://ec.europa.eu/consumers/odr/.

(2) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 13 Final Provisions

(1) Should individual provisions of this contract be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected.

(2) The invalid or unenforceable provision shall be replaced by an effective provision that comes closest to the economic purpose of the invalid or unenforceable provision.

(3) The contract languages are English and German.

(4) The place of jurisdiction for all disputes arising from this contract is, to the extent permitted by law, the registered office of the Seller in Paphos, Cyprus. For consumers, this jurisdiction agreement applies only insofar as protection under mandatory provisions of the member state in which the consumer is domiciled is not withdrawn.
